The controller of your data is Examica Sp. z o.o. with its registered office at ul. 1. For what purposes do we process your data

We process your data to enable a User of our Platform to send you messages. The legal basis for data processing is our legitimate interest (Art. 6(1)(f) GDPR), which includes:

• enabling communication between Users of our Platform and individuals who may be interested in the received message,

• ensuring the functionality of the Platform in accordance with its purpose,

• defense against potential claims and ensuring compliance with legal provisions.

2. Categories of Personal Data

The processing of your Personal Data includes the following categories of your data: email address and, if applicable, name and surname.

3. Data Recipients

Your Personal Data may be transferred to:

• Entities cooperating with us, providing or handling payments due to us, being a provider of analytical services or an IT service provider, including hosting services.

• Entities processing Personal Data on our behalf, in particular providers of IT services, technological or business support services, marketing agencies, providers of analytical services, or debt collection services.

• We may provide Personal Data to public authorities based on legal provisions in connection with ongoing proceedings regarding possible violations of the law.

4. Data Storage Period

Your Personal Data will be processed for the period necessary to achieve the purpose for which it was collected. The storage period of personal data may in each case be extended by the period of limitation of claims, if the processing of personal data is necessary for pursuing potential claims or for defending against such claims by us.

5. Transfer of data to a third country or international organization

1. Your Personal Data may be transferred outside the EEA as part of our use of services provided by suppliers of IT systems and solutions, who may store personal data on servers located outside the EEA (including in the United States), or as part of providing services related to our business activities – to the extent necessary for their execution.

2. The transfer of your Personal Data outside the EEA, referred to in point 1, will take place based on a decision of the European Commission stating an adequate level of Personal Data protection under the legislation of a third country, or by applying appropriate legal safeguards, which include in particular standard contractual clauses for Personal Data protection approved by the European Commission, and in justified situations – also by applying supplementary measures to transfer tools to ensure compliance with the level of Personal Data protection of the European Union.

3. In the absence of a decision by the European Commission stating an adequate level of Personal Data protection under the legislation of a third country or the absence of applying appropriate legal safeguards, your Personal Data may be transferred to a third country based on one of the grounds listed in Art. 49(1) GDPR, including in particular based on your explicit consent. You have the right to obtain a copy of the Personal Data transferred to a third country.

6. Your Data Rights

You have the right to access your data and the right to request their rectification, erasure, or restriction of their processing.

As your data is processed in an automated manner based on an agreement, you also have the right to data portability regarding the Personal Data you have provided to us, i.e., to receive your Personal Data from us in a structured, commonly used, machine-readable format. You can transmit this data to another data controller.

7. Right to Object

To the extent that the basis for processing your Personal Data is the ground of legitimate interest, you have the right to object to the processing of your Personal Data, i.e., you have the right to object to the processing of data for direct marketing purposes.

8. Right to File a Complaint with a Supervisory Authority

You also have the right to file a complaint with the supervisory authority responsible for personal data protection in the Member State of your habitual residence, place of work, or place of the alleged infringement.

9. Information on the Voluntary or Mandatory Nature of Data Provision

Providing Personal Data for the purpose of creating an account is necessary for concluding and performing an agreement – without providing Personal Data, it is not possible to conclude an agreement and provide services to you.

Providing data for marketing purposes is voluntary.

10. Changes to this Policy

Examica reserves the right to change this Respondents' Privacy Policy at any time. Please periodically check this page for updates. If we significantly change the way we use your Personal Data, we will notify you by email.
